TruFolio is a software-as-a-service (SaaS) platform that enables licensed financial professionals ("Agents") to deliver a branded financial assessment experience to their prospects and clients ("Prospects"). TruFolio provides tools for financial data collection, calculation of a Financial Clarity Score, generation of an intelligence brief for Agents, and related services.
Financial professionals who register for a TruFolio account ("Agent Account") represent and warrant that:
Prospects who complete a financial assessment through TruFolio do not need to create an account. By completing and submitting an assessment, Prospects consent to sharing their financial information with the Agent whose link they used to access the Platform.
Agent Accounts are available on a monthly subscription basis. Current plan pricing is available at trufolio.app/trufolio_pricing.html. Pricing is subject to change with 30 days notice to active subscribers.
Each plan includes a fixed number of agent seats. If your organization adds agents beyond your plan's included seats, additional seats are billed at your current plan's per-seat overage rate — you are not automatically upgraded to a higher tier. Per-seat overage rates are: Growth $65/seat/month, Team $60/seat/month, Agency $55/seat/month. You may upgrade to a higher tier at any time if the flat rate becomes more economical.
New Agent registrations include a 30-day free trial. No credit card is required to start the trial. If you choose to continue after the trial period, you will be required to provide payment information and will be charged the applicable subscription fee.
Subscriptions are billed monthly on the anniversary of your subscription start date. All payments are processed by Stripe. By providing payment information, you authorize TruFolio to charge your payment method on a recurring monthly basis until you cancel.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will not be charged for the following month. No prorated refunds are provided for partial billing periods.
TruFolio does not provide refunds for subscription fees already charged, except in cases of billing errors. If you believe you were charged in error, contact joe@trufolio.app within 30 days of the charge.
You agree not to use the Platform to:
The Platform, including its software, design, branding, Financial Clarity Score algorithm, AI interview engine, and all related content, is owned by TruFolio Technology LLC and protected by copyright, trademark, and other intellectual property laws.
"TruFolio" and "See it clearly. Own it completely." are trademarks of TruFolio Technology LLC. You may not use these marks without written permission.
Agent Accounts include a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during the term of your subscription.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of information as described in the Privacy Policy.
Agents are responsible for ensuring they have appropriate consent from Prospects before sharing TruFolio assessment links with them, consistent with applicable privacy laws and professional obligations.
Agents are solely responsible for:
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRUFOLIO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUFOLIO TECHNOLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL TRUFOLIO'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO TRUFOLIO IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless TruFolio Technology LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.
TruFolio may suspend or terminate your account at any time for violation of these Terms, non-payment of subscription fees, or for any other reason with or without notice. Upon termination, your right to use the Platform ceases immediately. Data retention following termination is governed by our Privacy Policy.
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules, conducted in Utah. You waive any right to participate in a class action lawsuit or class-wide arbitration.
TruFolio reserves the right to modify these Terms at any time. We will notify active subscribers of material changes by email at least 14 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
